			<News:newsheading>Marion County Circuit Court Judge Mary Mertens James issued a decision favorable to our client, the Salem Urban Renewal Agency, in the Salem Conference Center case. The Salem Urban Renewal Agency was sued by the state Bureau of Labor and Industries for failure to require payment of prevailing wages on the Grand Phoenix Hotel, a hotel that is located adjacent to the publicly-owned Salem Conference Center. The Bureau contended that the timing of the construction of the hotel, its proximity to the conference center, certain development requirements imposed by the Agency and the interconnectivity between the operations in both buildings (which include the Agency's leasing of some space in the hotel) created an obligation of the Agency and the hotel general contractor to pay prevailing wages. Based on the private ownership, financing and operations of the hotel we argued that there was not sufficient public involvement in the hotel to require payment of prevailing wages. After reviewing the parties' cross-motions for summary judgment, Judge James agreed with our position, holding that state laws regarding payment of prevailing wages do not apply to the hotel.</News:newsheading>

In one case, the Court held that probable cause of a violation would be required and that there must be an appropriate warrant; in the second case, the Court found that there was inadequate authority under existing Washington law for &quot;administrative warrants.&quot;

Pasco's programs allows landlords to select a city inspector, a trained private inspector certified by the city or the U.S. Department of Housing and Urban Development, or a licensed structural engineer or architect. The inspector provides the landlord with a certification of code compliance, but is not required to provide the inspection report to City officials. The landlord simply must fix anything that is found out of compliance, until a certificate is finally provided. The Court ruled that because a landlord in Pasco has wide discretion in choosing which professional to carry out an inspection, and because the inspection report is not provided to the government, no &quot;state action&quot; is involved. In other words, although the ultimate result will be to cause all units to comply, the process is sufficiently private so that no governmental searches or privacy invasions are involved. 			<News:newsheading>Representing a first step of many in restoring physical education to Oregon schools, Governor Ted Kulongoski signed House Bill 3141 into law today to arrest the obesity epidemic and the growing levels of inactivity of Oregonâ€ s youth. The new legislation establishes a standard of 150 minutes per week or PE instruction for elementary and 225 minutes per week for middle school students to ensure that physical education is a component of every K-8 school curriculum throughout Oregon.

The new legislation provides $1 million, with $860,000 targeted for a grant program to support schools in meeting the new minimum standards for PE instruction. The remaining $140,000 is allocated to fund a much-needed statewide inventory of PE instruction around the stateâ€ s 200-plus school districts. The inventory will provide future legislatures with data to determine future funding needs to fully implement the PE grant program within the decade.

Childhood obesity is a serious problem in Oregon. 25 percent of Oregonâ€ s 8th graders are overweight or at risk for becoming overweight and this number has been increasing. The rise in childhood obesity is partly due to the fact that physical education was no longer a mandatory part of the school day. Lack of PE not only leads to overweight, unhealthy children, but also makes children less ready to learn in the classroom. The cost of obesity is alarming: $781 million was spent in Oregon in 2003 on obesity-related medical costs.

The enlightened PE legislation, seen as a victory for more healthy kids, was championed by Senate President Peter Courtney, Majority Leader Richard Devlin, and Senator Kate Brown. As president, Neukom will focus on collaboration, within the association as well as with other associations; strategic management and structure; improved information technology; an enhanced culture of inclusion and opportunity; and the â€˝World Justice Project,â€ť an effort to create a multi-national and multi-disciplinary movement to advance the rule of law in the United States and in other countries.
