			<title>Eaton Peabody</title>
			<description>Address : Fleet Center-Exchange StreetP.O. Box 1210, Phone : 207-947-0111, City : Bangor</description>
<News:newsheading>The City Council Monday unanimously approved a $50,000 contract with Eaton Peabody Consulting Group to prepare an economic development strategy.

"We want a working document . so we have results," said Micki Sumpter, executive director of the Ellsworth Area Chamber of Commerce. The city contracts with the chamber for economic development services.

Greg A. Mitchell will serve as project manager.

"You've got a lot of new retail investment," Mitchell told the council. "That tells me you want to look at economic diversification."

The strategy would address the following issues: economic diversification, capital improvements, assessment of future land needs and staffing needs for economic development efforts.

The city will fund the study with $20,000 in revenue from the Beckwith Hill tax increment-financing district. The remaining $30,000 will come from Coastal Acadia Development Corp. The city has given the development corporation money in recent years for economic development assistance. But, the organization is not as active as it has been.

"I'm very much in favor of this roadmap," said Council Chairman Gary Fortier.

Councilor John Moore said, "They seemed to be tuned in very closely with what we wanted to hear."

Councilor Stephen Beathem said it was tough to get him to approve spending money but Ellsworth has numerous projects throughout the city.

"We need something to bring it all together," Beathem said.

Sumpter said, "I promise I won't allow it to sit on a shelf. We will move forward."

The study is to be finished by Sept. 24.</News:newsheading>

<News:newsheading>Judgment for defendants represented by Mr. Huntington was recently entered in this case after a trial in Superior Court in February before Justice S. Kirk Studstrup. At the two-day trial, the plaintiffs' claimed that a floating dock installed seasonally on the coast of Maine and maintained by Mr. Huntington's clients as part of their business interfered with access to open water from the plaintiffs' property, next door to the campground, and therefore was enjoinable as a common law nuisance. The plaintiffs presented the testimony of a surveyor who measured and mapped water depths in the cove shared by the parties and the clearances between the defendants' dock and the rocks and shorelines adjacent to it. Among the witnesses called by Mr. Huntington for the defense was a former harbormaster from the area who testified that the dock was not a navigational hazard for a prudent mariner.

In denying the plaintiffs' claim, the court applied the common law of private nuisance in Maine. It held that the plaintiffs had failed to prove that any interference with the plaintiffs' access resulting from the uses and location of the dock was unreasonable. In Mr Huntington's view, the issues at the trial were intensively factual, and when all the facts related to the cove, the tides, the history, and the uses were presented and considered, the court concluded that there was no good reason to require a change in the dock under the circumstances.</News:newsheading>

<News:newsheading>The law firm of Eaton Peabody has announced the addition of David Pierson to the Litigation/Dispute Resolution practice in the Brunswick office.

Pierson, who has been a member of the Maine Bar for over 13 years, built his practice by representing contractors, subcontractors, modular home manufacturers and dealers in residential and commercial construction matters. Prior to attending law school, he enjoyed a successful fifteen-year career in construction and construction management as President of Pierson -Woodward General Contractors and D. C. Pierson, Inc, Construction Management.

Pierson currently serves as corporate counsel for the Downeast Chapter of the Associated Builders and Contractors, the Maine Home Builders and Remodelers Association and the Modular Homebuilders Association of Maine. Pierson was named the Associate Member of the Year by the Homebuilders and Remodelers Association of Maine in 2002. He is also a frequent mediator in business and construction disputes.

&quot;We are very pleased to welcome David Pierson to our Brunswick office," said Dan McKay, Eaton Peabody CEO. "We expect that David's unique background and recognized expertise in resolving construction disputes and in construction litigation will be a tremendous asset to Eaton Peabody's clients.&quot;

Pierson also represents clients in commercial, land use and boundary disputes. In 2003, in a case before the Maine Supreme Judicial Court, he protected landowners' rights to appeal certain decisions by municipal codes enforcement officers who issue building permits for neighboring properties by gaining an exception for Mainers from strict compliance for notice requirements for abutting property owners. This precedent gives comfort to Mainers, especially with those with secondary or seasonal properties, that they must be informed about their neighbor's construction plans.

Pierson represented the City of Lewiston for five years assisting in numerous land use enforcement actions, real estate and economic development matters including the Lewiston Wal- Mart distribution center project.

&quot;During my time as the Assistant City Administrator of the City of Lewiston, I had the honor of working with Pierson,&quot; said Greg Mitchell, Eaton Peabody Consultant. &quot;He demonstrated a strong work ethic and I found him to be both competent and creative regarding his approaches to several challenging projects.&quot;

Pierson is a past president of the Androscoggin County Bar Association and is a Director and immediate past president of the Auburn Business Development Corporation, and a Director of the Lewiston Development Corporation, and the Good Shepherd Food Bank. He is a graduate of Bates College, The Graduate Faculty of the New School for Social Research in New York city and the University of Maine School of Law. He was recently recognized by his peers for inclusion in the 2007 edition of Best Lawyers in America for construction law.

Pierson and his family currently reside in Portland and on Great Diamond Island.</News:newsheading>

<News:newsheading>The University of Maine School of Law has created a new endowment fund in honor of Vincent L. McKusick, former Chief Justice of the Maine Supreme Judicial Court, with an initial pledge of $100,000 from Pierce Atwood LLP.

The Vincent L. McKusick Fellowship Fund is designed to provide tuition and other support to incoming law students from socio-economically disadvantaged backgrounds, with the intent of increasing the diversity of the student body at the Maine Law School and within the legal community in Maine. The goal is to award the first McKusick Fellowship in 2009, after further fundraising efforts increase the endowment to a $250,000 threshold. The Fund will be held by the University of Maine School of Law Foundation, which will assist in securing additional support and growing the endowment significantly larger in the coming years.

"We sincerely thank Pierce Atwood for such a generous gift and value this commitment to diversity," says Peter Pitegoff, dean of the University of Maine School of Law. "We are especially pleased to honor Chief Justice McKusick, who has inspired so many people in Maine and nationally with his dedication to the legal profession and to social justice."

In 1952, Mr. McKusick began his career at Pierce Atwood LLP after graduating from Bates College and Harvard Law School and serving as a law clerk to Second Circuit Chief Judge Learned Hand and then to U.S. Supreme Court Justice Felix Frankfurter. From 1943 - 1946, he served in the U.S. Army, participating for fourteen months in the Manhattan Project in Los Alamos, New Mexico.

In 1977, Maine Governor Longley appointed Mr. McKusick Chief Justice, the first such appointment directly from the bar since the appointment of Chief Justice Prentiss Mellon in 1820. Following his retirement from the bench in 1992, he rejoined Pierce Atwood LLP, where he continues serving today as Of Counsel. In that time, Chief McKusick has received three special master appointments from the U.S. Supreme Court, handling original jurisdiction cases between states.

During his fourteen-and-one-half years on Maine's high court, Chief McKusick brought significant improvements in the structure and operation of all courts, many involving volunteer efforts from within the community, such as Maine's Mediation Program and its Court Appointed Special Advocate (CASA) Program.

"This is a great honor for a great man. Chief McKusick has been a mentor to so many people in the legal profession and now that legacy will continue as students who have historically been disadvantaged in education and the workplace will have a chance to develop a career in the law," says Bruce Coggeshall, managing partner, Pierce Atwood LLP.

Students who have attended secondary or post-secondary school in Maine will be given preference for the fellowships. The program will reach out to members of Maine's new immigrant communities and members of Maine's Native American communities. Fellowship awards will include a part-time paid internship at Pierce Atwood during the recipients' second academic year at the Law School.

In a June '07 article authored by Chief McKusick for The Journal of Appellate Practice and Process, entitled "A Firm Foundation for Life After the Bench," the Chief describes his great satisfaction in hosting regular lunch meetings with new associates and summer clerks at Pierce Atwood LLP. "It's obvious that the Chief has a love of the law and the legal profession that he hopes to instill in the newest generation of lawyers. We trust that this fellowship allows him to do just that," states Pitegoff.

Chief McKusick grew up in Parkman near Dover-Foxcroft, and now resides with his wife Nancy in Cape Elizabeth.

<News:newsdescription>The University of Maine School of Law has created a new endowment fund in honor of Vincent L.
