The focus of the testimony was related to releasing names in the case of 3-year-old Marcus Fiesel, who died in August 2006 when his foster parents tied him up and left him in a closet. Liz and David Carroll Jr. were later convicted of his murder. There is currently a proposed House amendment that would release the names and other details about foster parents only after their license is revoked.

"The public came to know Marcus' foster parents only when it was too late to raise concerns about their fitness,'' Greiner testified. "And what the public learned made all of us question why that boy was placed in that house. It is important to remember that Marcus Fiesel died not because the public knew too much about his situation, but because the public knew too little."

Greiner practices in the areas of commercial litigation, with a focus on media and First Amendment law, and employment law. He has handled dozens of First Amendment cases and helped establish precedent-setting case law requiring that records be available to the public. Greiner earned his B.A., cum laude, in Political Science/Economics from Miami University and his J.D., cum laude, from the University of Notre Dame.</News:newsheading>

During his term as board president, CFC completed its most successful fund raising campaign in the history of the organization and transitioned its leadership to a new Executive Director. The Award was established in 1971 by Pauline Cohen and Justin Friedman, who served as President of CFC's Board of Trustees from 1971-1973 and continued as a Trustee until 1979.

If the workforce is not as diverse as the population in the area, it could pay to know why. Perhaps the applicant pool is skewed. I had a client with many jobs that were basically agricultural. A huge percentage of the applicants for those jobs were men. When this client was sued for sex discrimination, the gender gap was not an issue.

If the reasons for lack of diversity are not obvious, a company can take a look at the method for publicizing job opportunities. If all of the workers are from one group and word of mouth is the only way job openings are communicated, any disparity can continue indefinitely. In that case, the employer could consider other ways of posting or advertising jobs.

Review application form

The hiring process usually starts with an application form. A company should review its form to see what information is requested and decide whether the information is important.

Remember that employers cannot discriminate on the basis of race, gender, age, ethnic origin, religion or disability. Companies should avoid asking questions about that information, or even questions that elicit that information. Once an employer has gathered the information, it's harder to claim that it wasn't used in the hiring process.

To use an obvious example, there is no need to ask an applicant about his or her race or ethnicity.

A trickier problem involves questions that ask an applicant to disclose physical or mental disabilities. The question: &quot;Are you disabled?&quot; is obviously a problem. But questions about the applicant's health history or prior workers' compensation claims can also come back to haunt the employer.

Employers are not required, though, to hire applicants who cannot perform the essential functions of the job. If the job requires lifting 50 pounds frequently, the company can ask applicants if they can do that.

Lexmark International is one of the world's largest printer manufacturers for homes and offices.

The decision is viewed as a win for consumers and their right to choose from whom they would buy their cartridges. &quot;I think this is a very pro-consumer, money-saving, economically sound decision for the American consumer,&quot; said Static Control CEO Ed Swartz. Analysts spoke of how a verdict for Lexmark could have drastically changed the market for toner cartridges, and hailed Static Control for standing up to the printer manufacturers on behalf of the aftermarket.
