Cooley Godward Kronish LLP’s bankruptcy and restructuring practice has prevailed for the unsecured creditors of Norstan’s, a women’s budget retailer, in obtaining the desired settlement of a $67 million fraudulent transfer lawsuit arising out of a $53 million leveraged buyout and an earlier distribution of $14 million to insider shareholders.

The ruling approving the settlement was issued in the U.S. Bankruptcy Court’s Eastern District of New York on July 31 by Chief U.S. Bankruptcy Judge Carla E. Craig. The lawsuit, on behalf of the unsecured creditors, asserted that in the months before declaring bankruptcy, Norstan’s made distributions of $14 million to the company shareholders and thereafter leveraged its own stock to transfer $53 million to those same shareholders.

“We are pleased with the court’s approval today of the settlement supported by the Official Committee of Unsecured Creditors,” said Cooley partner Ronald R. Sussman. “The transfers associated with Norstan’s leveraged buyout were constructively fraudulent and today the unsecured creditors received a fair settlement for the damages they sustained.” In addition to Sussman, Cooley Partner Lawrence C. Gottlieb and Associates Jeffrey L. Cohen, Seth Van Aalten and Michael Klein advised on the matter.

Cooley Godward Kronish LLP announced today it has been ranked the #2 Intellectual Property law firm in the country by IP Law & Business based on its representation of plaintiffs in patent litigation matters. The publication’s annual patent litigation survey ranks IP groups across the county by the volume of their plaintiffs, defense and total patent cases filed.

This is the second significant recognition Cooley's intellectual property practice has earned recently. The Firm also ranked #11 in the country in the IP Law360 survey of top IP litigation firms for 2006. Cooley’s three-fold increase in cases over the prior year was the largest percentage increase from 2005 to 2006 among all ranked firms.

“This ranking validates Cooley's position as one of the premier intellectual property practices in the country and is terrific recognition for our team,” said Frank Pietrantonio, head of Cooley’s Intellectual Property practice group. “We are privileged to be called upon to protect and defend the intellectual property rights of some of the world's leading companies, helping them navigate the rapidly changing IP legal landscape."

Cooley’s Intellectual Property practice group has added key talent over the past two years in areas that are of increasing need by clients, including life sciences-related patent prosecution and counseling, trade secrets theft and economic espionage and international trademark and copyright protection. The firm represents clients across multiple industry sectors, including technology, life sciences, energy, banking and retail.
